Ambrose Bierce satirized litigation “as a machine in which you go into as a pig and come out as a sausage”. This is an appropriate aphorism to describe litigation in India. Thus, it is my utmost belief that India needs to possess a strong ADR system to ensure justice is delivered in a timely manner. However, it goes without saying that not only must Justice be done; it must also be seen to be done. This can happen only if neutrals in ADR are seen as a perfect substitute for judges in court. Thus, with this credence in mind when I occupy the seat of a neutral I consider myself nothing less than a judge sitting in court and thus carry with me all its connected responsibilities, the most pivotal of which is being 'fair and neutral'.
